1) Acceptance of Terms

By accessing pocadair.com or using any services provided by POCAD Remodeling Inc. (“POCAD,” “we,” “us,” or “our”), you agree to these Terms & Conditions and all applicable laws. If you do not agree, please discontinue use of this site and our services.

2) Who We Are & Scope of Services

POCAD is more than an HVAC company. We are a full-service HVAC contractor and the operator of the POCAD Platform — a connected home-comfort ecosystem that pairs licensed field service with modern software: a client portal and mobile apps, membership plans, the ClimaScore™ system-health index, an AI HVAC Companion, and the POCAD Rewards Network.

Our field services cover HVAC blueprint execution, installation & repair across the Tri-County Area (Miami-Dade, Broward & Palm Beach Counties) for residential and commercial projects—delivered with clean workmanship, code compliance, and on-time execution.

3) Platform Accounts & Mobile Apps

• Some digital services require creating an account. You agree to provide accurate information, keep your login credentials confidential, and notify us of any unauthorized use of your account.
• You are responsible for activity that occurs under your account. We may suspend or terminate accounts used in violation of these Terms, applicable law, or the security of the Platform.
• Use of the client portal and mobile apps by account holders is additionally governed by the POCAD Platform Terms & Conditions, which you accept when you create or use an account. If these website Terms and the Platform Terms conflict with respect to Platform use, the Platform Terms control.

4) Memberships & Subscriptions

• Membership plans renew automatically on a recurring billing cycle until cancelled. Current plan benefits, pricing, and cancellation options are shown in the client portal before you subscribe.
• Subscription payments are processed by our secure payment providers (including Stripe and, for purchases made inside our iOS app, Apple In-App Purchase). We do not store full card numbers.
• Except where required by law or expressly stated in a plan, membership fees for a current billing period are non-refundable; cancelling stops future renewals.

5) ClimaScore™ & AI-Powered Features

• ClimaScore™ is an informational health index generated from system data and technician inspections. It is not a warranty, a guarantee of equipment performance or lifespan, an insurance product, or a substitute for professional inspection.
• The AI HVAC Companion generates responses automatically using artificial intelligence. Its answers are informational only, may contain errors, and are not professional advice or a diagnosis. Always confirm safety-critical or repair decisions with a licensed technician.
• AI features and usage allowances may vary by membership tier and may be modified, limited, or discontinued at any time.
• ClimaScore™ and the POCAD Platform software are owned by Zul Spot LLC and operated by POCAD under license (see Section 17).

6) POCAD Rewards Network (Referral Program)

• The POCAD Rewards Network (“PRN”) lets eligible members earn rewards for qualified referrals. Enrollment, reward rules, and payout conditions are described in the PRN portal and its program terms, which govern participation.
• Rewards accrue only on qualified, completed transactions as defined by the program rules. Self-referrals, fraudulent activity, or gaming of the program will void rewards and may result in removal from the program.
• POCAD may modify, suspend, or discontinue the program at any time; earned and confirmed rewards will be honored per the program terms in effect when they were earned.

7) Estimates & Proposals

• Written estimates are valid for 30 days from the issue date.
• Pricing may change based on site conditions, code updates, material fluctuations, or client-requested revisions.
• Changes to scope require a written change order approved by both parties.
• Verbal instructions are not binding until confirmed in writing by POCAD.

8) Payments & Deposits

• A non-refundable deposit of 30–50% is required prior to scheduling or mobilization.
• Remaining balances are due upon substantial completion or per written progress schedule.
• Accepted payments: cash, check, ACH, Zelle, approved electronic transfer, and major credit/debit cards processed securely through our payment provider (Stripe).
• Past-due invoices accrue 1.5% monthly interest (or legal maximum). Returned checks incur a $50 fee plus collection costs.
• Client agrees to pay reasonable attorney fees, court costs, and collection expenses if enforcement is required.

9) Scheduling & Access

• Schedules may adjust due to weather, permitting, inspections, labor, or supply conditions.
• Client must provide safe, unobstructed access and ensure utilities (power, water) are available.
• Delays caused by inaccessibility or unsafe conditions may result in additional charges.

10) Permits, Licensing & Compliance

Work complies with the Florida Building Code, OSHA safety standards, and EPA Section 608 refrigerant handling requirements. Where required, permits will be obtained as specified in the written contract; permit and inspection fees are the responsibility of the party designated in that agreement.

11) Warranties & Limitations

• Labor Warranty: 90-day limited warranty from substantial completion unless otherwise stated in writing.
• Manufacturer Warranty: Per manufacturer terms; registration and maintenance may be required.
• Warranties are void if payment is incomplete, equipment is altered by others, maintenance is neglected, or damage results from misuse or acts of God.
• POCAD’s total liability for any claim shall not exceed the amount paid for the specific service.

12) Limitation of Liability

To the fullest extent permitted by law, POCAD is not liable for indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, or use). POCAD is not responsible for pre-existing or hidden conditions, structural defects, or incidental damage necessary to perform work (e.g., drywall openings, minor paint touch-ups, landscaping disturbance). Digital services — including the Platform, ClimaScore™, and AI features — are provided “as is” and “as available.” Client’s exclusive remedy is repair, replacement, or refund of the affected portion of work.

13) Client Responsibilities

• Provide accurate project information and maintain a safe work environment.
• Disclose known hazards (mold, asbestos, gas leaks, wiring issues) and maintain appropriate property insurance.
• Secure pets, valuables, and fragile items prior to service.

14) Subcontractors & Partners

POCAD may subcontract portions of work to licensed and insured professionals under its oversight. Client agrees not to solicit or hire such subcontractors directly for related work for 12 months after project completion.

15) Indemnification

Client agrees to indemnify, defend, and hold harmless POCAD Remodeling Inc., its officers, employees, agents, and subcontractors from claims, damages, liabilities, and expenses arising from Client’s breach of these Terms, misuse of installed systems, or undisclosed hazardous conditions.

16) Force Majeure

POCAD is not liable for delays or non-performance caused by events beyond its control, including natural disasters, fire, flood, pandemics, labor disputes, supplier failures, or government actions.

17) Intellectual Property & Website Use

All content on this Website (text, images, logos, layout) is owned by or licensed to POCAD Remodeling Inc. You may not copy, modify, distribute, or create derivative works without prior written consent.

The POCAD Platform, the POCAD mobile applications, and ClimaScore™ — including its scoring methodology and related technology — are owned by Zul Spot LLC and operated by POCAD under license. ClimaScore™ is a trademark of Zul Spot LLC. No rights in the Platform, the apps, or ClimaScore™ are transferred to you other than the limited right to use them as an end user under these Terms and the Platform Terms.

18) Privacy & Data Use

Information submitted via forms (quotes, contact requests) and through the Platform is used for scheduling, communication, service delivery, and billing. We do not sell personal data. See our Privacy Policy for details; Platform account holders are also covered by the POCAD Platform Privacy Policy.

19) Governing Law & Dispute Resolution

These Terms are governed by Florida law. The parties will first attempt good-faith mediation in Broward County, FL. If unresolved, exclusive venue lies in the Circuit Court of Broward County, Florida. The prevailing party may recover reasonable attorney’s fees and costs.

20) Amendments

POCAD may update these Terms at any time. Changes are effective when posted on this page with a revised “Last Updated” date. Continued use of the Website or services constitutes acceptance of the updated Terms.
