1) Acceptance of Terms
By accessing pocadair.com or using any services provided by POCAD Remodeling Inc. (“POCAD,” “we,” “us,” or “our”), you agree to these Terms & Conditions and all applicable laws. If you do not agree, please discontinue use of this site and our services.
2) Scope of Services
POCAD Remodeling Inc. provides HVAC blueprint execution, installation & repair services across the Tri-County Area (Miami-Dade, Broward & Palm Beach Counties) for residential and commercial projects—delivered with clean workmanship, code compliance, and on-time execution.
Service Divisions
- HVAC Design & Construction (Blueprint Execution) — We execute engineered HVAC plans, coordinate with GCs and trades, and ensure airflow balance and inspection approvals.
- Installation & Replacement — Ductwork fabrication and fitting, AC installation, and equipment replacement, verified for performance, efficiency, and Florida Building Code standards.
- Diagnostics & Repair — Precise troubleshooting and repairs for major HVAC brands; from refrigerant issues to electrical faults, we restore comfort fast—done right the first time.
3) Estimates & Proposals
- Written estimates are valid for 30 days from the issue date.
- Pricing may change based on site conditions, code updates, material fluctuations, or client-requested revisions.
- Changes to scope require a written change order approved by both parties.
- Verbal instructions are not binding until confirmed in writing by POCAD.
4) Payments & Deposits
- A non-refundable deposit of 30–50% is required prior to scheduling or mobilization.
- Remaining balances are due upon substantial completion or per written progress schedule.
- Accepted payments: cash, check, ACH, or approved electronic transfer.
- Past-due invoices accrue 1.5% monthly interest (or legal maximum). Returned checks incur a $50 fee plus collection costs.
- Client agrees to pay reasonable attorney fees, court costs, and collection expenses if enforcement is required.
5) Scheduling & Access
- Schedules may adjust due to weather, permitting, inspections, labor, or supply conditions.
- Client must provide safe, unobstructed access and ensure utilities (power, water) are available.
- Delays caused by inaccessibility or unsafe conditions may result in additional charges.
6) Permits, Licensing & Compliance
Work complies with the Florida Building Code, OSHA safety standards, and EPA Section 608 refrigerant handling requirements. Where required, permits will be obtained as specified in the written contract; permit and inspection fees are the responsibility of the party designated in that agreement.
7) Warranties & Limitations
- Labor Warranty: 90-day limited warranty from substantial completion unless otherwise stated in writing.
- Manufacturer Warranty: Per manufacturer terms; registration and maintenance may be required.
- Warranties are void if payment is incomplete, equipment is altered by others, maintenance is neglected, or damage results from misuse or acts of God.
- POCAD’s total liability for any claim shall not exceed the amount paid for the specific service.
8) Limitation of Liability
To the fullest extent permitted by law, POCAD is not liable for indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, or use). POCAD is not responsible for pre-existing or hidden conditions, structural defects, or incidental damage necessary to perform work (e.g., drywall openings, minor paint touch-ups, landscaping disturbance). Client’s exclusive remedy is repair, replacement, or refund of the affected portion of work.
9) Client Responsibilities
- Provide accurate project information and maintain a safe work environment.
- Disclose known hazards (mold, asbestos, gas leaks, wiring issues) and maintain appropriate property insurance.
- Secure pets, valuables, and fragile items prior to service.
10) Subcontractors & Partners
POCAD may subcontract portions of work to licensed and insured professionals under its oversight. Client agrees not to solicit or hire such subcontractors directly for related work for 12 months after project completion.
11) Indemnification
Client agrees to indemnify, defend, and hold harmless POCAD Remodeling Inc., its officers, employees, agents, and subcontractors from claims, damages, liabilities, and expenses arising from Client’s breach of these Terms, misuse of installed systems, or undisclosed hazardous conditions.
12) Force Majeure
POCAD is not liable for delays or non-performance caused by events beyond its control, including natural disasters, fire, flood, pandemics, labor disputes, supplier failures, or government actions.
13) Intellectual Property & Website Use
All content on this Website (text, images, logos, layout) is owned by or licensed to POCAD Remodeling Inc. You may not copy, modify, distribute, or create derivative works without prior written consent.
14) Privacy & Data Use
Information submitted via forms (quotes, contact requests) is used for scheduling, communication, and billing. We do not sell personal data. See our Privacy Policy for details.
15) Governing Law & Dispute Resolution
These Terms are governed by Florida law. The parties will first attempt good-faith mediation in Broward County, FL. If unresolved, exclusive venue lies in the Circuit Court of Broward County, Florida. The prevailing party may recover reasonable attorney’s fees and costs.
16) Amendments
POCAD may update these Terms at any time. Changes are effective when posted on this page with a revised “Last Updated” date. Continued use of the Website or services constitutes acceptance of the updated Terms.
