1. INTRODUCTION & ACCEPTANCE OF TERMS
These Terms & Conditions (“Terms”) form a legally binding contract between you (“Client,” “User,” or “You”),
POCAD Remodeling Inc. (“POCAD”), and Zul Spot LLC (“Zul Spot”), the exclusive creator and
owner of the ClimaScore™ Health Evaluation Technology and related HVAC scoring algorithms.
Your access to the POCAD Client Dashboard—including but not limited to your:
- Client Dashboard
- System Dashboard
- Visit and History Viewer
- Smart Maintenance Viewer
- Membership Section
- ClimaScore™ Health Score Page
- AI HVAC Companion
- Uploaded documents section
- Any future tools, modules, or digital services integrated into the dashboard
(collectively, the “Platform”) is conditioned strictly upon your compliance with these Terms.
By accessing the Platform, you:
- 1. Agree to be bound by these Terms without modification, and affirm this agreement each time you log in.
- 2. Acknowledge that these Terms supersede any verbal, text message, or email explanations.
- 3. Agree to all disclaimers, liability limitations, arbitration clauses, indemnifications, and restrictions stated herein.
- 4. Accept full responsibility for how you use the Platform, the score, AI outputs, and all related data.
- 5. Acknowledge the Platform does not replace a licensed HVAC technician.
If you do not agree to these Terms, you must immediately discontinue use and request account closure.
These Terms are intentionally comprehensive and detailed to protect all parties, especially against misuse, misunderstanding,
and unsafe behavior related to HVAC systems.
2. OWNERSHIP OF TECHNOLOGY & INTELLECTUAL PROPERTY
2.1 ClimaScore™ Owned Exclusively by Zul Spot LLC
You acknowledge and agree that:
- Zul Spot LLC is the sole and exclusive owner of the ClimaScore™ HVAC Health Scoring System, including all underlying intellectual property.
- This includes—but is not limited to—data structures, formulas, algorithms, weighting logic, state-specific scoring profiles, technical criteria, color schemes, thresholds, user flows, interface elements, statistics, and conceptual design.
- The system dashboard, health score displays, graphs, ranges, ratio outputs, prompts, explanations, and visual representations of health score logic are ALL derived from Zul Spot LLC intellectual property.
POCAD Remodeling Inc. is merely a licensed user of ClimaScore™ for the purpose of enhancing HVAC service delivery.
The Client receives only viewing access. No rights of ownership or use are transferred.
2.2 Prohibited Actions
You are expressly prohibited from:
- Extracting, reverse-engineering, reconstructing, re-weighting, or analyzing ClimaScore™ outputs.
- Attempting to rebuild the scoring model from technician inputs or outputs.
- Using ClimaScore™ as a database for building competing analytics.
- Creating “shadow copies” or derivative products based on ClimaScore™.
- Training machine learning, AI systems, or statistical models using ClimaScore™ outputs.
- Using screen recordings, scripts, bots, browser extensions, or scraping tools.
- Reproducing the visual design of the ClimaScore™ interface.
- Documenting or publishing research intended to infer its internal calculations.
- Providing platform access to a competitor, trainer, analyst, or software developer.
ANY attempt to derive algorithmic behavior through repeated testing, sampling, data probing, or systematic experimentation
is considered algorithmic inference and is strictly prohibited.
Violations may result in:
- Permanent termination of dashboard access.
- Revocation of all memberships and perks.
- Civil penalties.
- Criminal prosecution under federal trade secret laws.
- Legal action from Zul Spot LLC for damages and injunctive relief.
This clause is permanent and survives the termination of your account indefinitely.
3. LICENSE GRANT & SCOPE OF USE
You are granted a limited, revocable, non-exclusive, non-transferable license to use the Platform solely for:
- Managing your property’s HVAC information.
- Viewing POCAD technician entries.
- Accessing service visit summaries.
- Viewing ClimaScore™ results for your equipment.
- Using the AI HVAC Companion for personal, at-home troubleshooting guidance.
- Booking or reviewing service appointments.
- Managing membership plans.
This license DOES NOT permit:
- Use of the Platform for ANY commercial purpose.
- Using dashboard screenshots for professional, consulting, or real estate evaluations.
- Using ClimaScore™ in legal disputes, warranty claims, insurance claims, property valuations, or contractor disputes.
- Altering, exporting, or reformatting the Platform’s data for use in apps, models, tools, or external dashboards.
This Platform is strictly for residential customer convenience. No professional, diagnostic, or financial decisions should
be based solely on dashboard information.
4. PLATFORM RELIABILITY & NO WARRANTIES
The Platform is provided “AS IS,” “AS AVAILABLE,” and WITH ALL FAULTS.”
This means:
- Data may be incomplete.
- Scores may reflect partial technician readings.
- AI responses may be incorrect.
- Dashboards may not match real-time system conditions.
- Scheduling availability may change without notice.
- Platform access may be temporarily unavailable.
- Technician-entered values may contain human error.
- Historical data may not always be perfectly accurate.
You agree that:
- Neither POCAD nor Zul Spot guarantees accuracy, completeness, or reliability.
- No information on the Platform should be considered HVAC advice, compliance guidance, or a measurement of safety.
No promises are made regarding:
- HVAC performance.
- System health.
- Electrical safety.
- HVAC lifespan.
- Warranty validity.
- Failure prediction accuracy.
- Emergency detection.
You accept full responsibility for verifying system conditions with a licensed POCAD technician.
5. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- POCAD
- Zul Spot LLC
- Their owners, employees, licensors, affiliates, and partners
ARE NOT LIABLE FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- HVAC breakdowns.
- Indoor air quality issues.
- Mold development.
- Water spills, attic damage, or condensate overflow.
- Misdiagnoses, delays, or technician errors.
- Electrical issues including tripped breakers or fires.
- Damage arising from following AI suggestions.
- Data inaccuracies.
- Missed maintenance or reminders.
- Any reliance on ClimaScore™ or AI outputs.
- Loss of property value.
- Personal injury.
ABSOLUTE LIABILITY CAP:
Maximum damages recoverable = $50 USD, no matter the situation.
This includes all:
- Claims.
- Disputes.
- Negligence allegations.
- Misinterpretation of ClimaScore™.
- Misuse of the AI HVAC Companion.
- Platform outages.
You explicitly waive the right to seek damages beyond this limit.
6. INDEMNIFICATION
You agree to fully indemnify, defend, and hold harmless POCAD and Zul Spot LLC—including their owners, subsidiaries, affiliates,
employees, agents, and licensors—from any and all claims, lawsuits, damages, liabilities, losses, costs, and attorney fees arising from:
- Your use or misuse of the Platform.
- Misinterpretation of ClimaScore™ results.
- Attempted self-repair or troubleshooting.
- Following AI HVAC Companion suggestions.
- Violation of these Terms.
- Unauthorized sharing of account access.
- Attempts to reverse-engineer or audit ClimaScore™.
- Damage caused to property or person due to your actions.
- Any legal action initiated as a result of Platform information.
This section is intentionally strict and survives termination forever.
7. CLIMASCORE™ HEALTH SCORE
ClimaScore™ is:
- A general HVAC condition indicator.
- Dependent on technician input quality.
- Influenced by data completeness.
- NOT a certified inspection.
- NOT a safety evaluation.
- NOT a substitute for on-site diagnostics.
- NOT predictive of future failure or emergencies.
ClimaScore™ does not check:
- Refrigerant charge.
- Electrical continuity.
- Combustion safety.
- CO levels.
- Duct leakage.
- Static pressure abnormalities not entered by the technician.
- Mold activity.
It is not a guarantee of reliability, lifespan, or value.
You agree ClimaScore™ cannot be used to:
- Price a home or property.
- Dispute other contractor quotes.
- Establish value for insurance.
- Claim warranty coverage.
- Claim negligence or misrepresentation by anyone.
It is exclusively an informational tool licensed to POCAD, not a certified metric.
8. AI HVAC COMPANION
The AI HVAC Companion:
- Uses probabilistic AI.
- Does not see, hear, or physically inspect your unit.
- May be wrong.
- May hallucinate incorrect information.
- Cannot diagnose safety risks.
- Cannot confirm refrigerant leaks.
- Cannot validate electrical integrity.
You agree NOT to:
- Remove access panels.
- Touch electrical components.
- Bypass float switches or safety sensors.
- Handle refrigerants.
- Modify wiring or connections.
- Enter unsafe attic/crawl spaces.
- Attempt DIY repairs the AI suggests.
- Ignore burning smells, smoke, buzzing, or rattling.
AI suggestions are only basic guidance, not professional instruction.
If the AI suggests something unsafe, you must ignore it and contact a technician immediately.
POCAD and Zul Spot LLC are not liable for any injury, damage, or loss resulting from AI use.
9. AI USAGE LIMITS
Your membership determines how many AI questions you may ask:
- Starter → 2 questions / 6 months
- Essential → 5 questions / 6 months
- Comfort Shield → 5 questions / 3 months
- Elite → 8 questions / month
You also agree NOT to:
- Use VPNs, proxies, or multiple accounts to bypass limits.
- Input intentionally misleading data.
- Abuse the AI with rapid or automated prompts.
- Treat the AI as a technician replacement.
POCAD may suspend AI access for any suspicious activity.
10. DATA LOGGING, TRACKING, AND AUDIT RIGHTS
POCAD permanently logs:
- Every AI question.
- Every AI response.
- IP address.
- Browser/device.
- Timestamp.
- Membership level.
- Usage count after each prompt.
These records may be used for:
- Quality control.
- Safety auditing.
- Abuse prevention.
- Legal defense.
- Membership verification.
You consent to these logs by using the Platform.
11. SAFETY WARNINGS
HVAC systems contain:
- High-voltage electricity.
- Pressurized refrigerant.
- Heavy components.
- Rotating fans.
- Electrical capacitors.
- Potential fire hazards.
- Condensate drainage risks.
DO NOT:
- Run the system during electrical smells.
- Operate if sparks or smoke appear.
- Leave water leaks unattended.
- Allow mold odors to persist.
- Touch anything without training.
Turn off the system and contact POCAD for any safety concern.
12. TERMINATION OF ACCESS
POCAD may terminate your account immediately, without refund, for:
- Attempting to reverse-engineer ClimaScore™.
- Creating multiple accounts.
- Abusing the AI system.
- Attempting unsafe repairs.
- Posting screenshots online for analysis.
- Sharing your login.
- Harassing staff or technicians.
- Violating any part of these Terms.
Zul Spot LLC may revoke POCAD’s ClimaScore™ license at any time. If so, ClimaScore™ features may disappear instantly without compensation.
You agree you will not seek damages for such removal.
13. GOVERNING LAW, JURISDICTION & ARBITRATION
All disputes must be resolved via binding individual arbitration.
- No jury trial.
- No class actions.
- No multi-plaintiff suits.
- No public court proceedings.
Arbitration venue = the county where the serviced property is located.
Arbitration decision = final, binding, and enforceable.
14. MODIFICATIONS TO TERMS
POCAD and Zul Spot may update these Terms:
- At any time.
- Without prior notice.
- Without obligation to notify you personally.
Your continued use of the Platform = acceptance of new Terms.
